OF THE EUROPEAN COMMUNITIES (Second Chamber),
gives the following
- in Case T-117/03:
- annul the decision of the Board of Appeal; - order OHIM and, where applicable, the intervener to pay the costs of the present proceedings and of the proceedings before the Board of Appeal.
- dismiss the action; - order the applicant to pay the costs.
