Having regard to the above application lodged on 19 June 2008,
Having deliberated, decides as follows:
PROCEDURE
The application was lodged by Ms Vasiliy Ivanovich Sorokopud, a Ukrainian national who was born in 1924 and lived in Konotop. The Ukrainian Government (“the Government”) were represented by their Agent, Mr Yuriy Zaytsev.
The applicant complained about non-enforcement of a judgment against a State authority in his favour.
On 11 February 2010 the case was communicated for information to the respondent Government.
By letter of 12 March 2010 Mrs Vera Yakovlevna Sorokopud informed the Registry that the applicant had died on 26 July 2008. By letter of 6 June 2010 Mrs V. Y. Sorokopud informed the Registry that she was the applicant’s ex-wife and wished to pursue his application based on the power of attorney issued to her by Mr Anatoliy Vasilyevich Sorokopud. However, neither Mrs V.Y. Sorokopud nor Mr A. V. Sorokopud provided any documentary proof that they were the applicant’s heirs. The Court has no information about any person who would be entitled to pursue the application.
In the light of the foregoing, the Court concludes that the conditions in which a case may be struck out of its list, as provided in Article 37 § 1 of the Convention, have been satisfied.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court unanimously
Decides to strike the application out of its list of cases.
