ELECTRICITY SUPPLY (NORTHERN IRELAND) ORDER 1972 - SECT 27



27.(1) Where the tariff or tariffs in force are not appropriate owing to
special circumstances, the Service may enter into agreements with any person
for the supply of electricity in accordance with the terms specified in the
agreement.

(2) Where any person has requested the Service

(a)to enter into an agreement with him under paragraph (1); or

(b)to renew an agreement entered into under paragraph (1); or

(c)to vary the terms of such an agreement,

(i)where his request to the Service to enter into or renew an agreement has
been refused, that, owing to special circumstances, the tariff or tariffs in
force are not appropriate to him;

(ii)where his request to the Service to vary the terms of an agreement has
been refused, that, owing to a change of circumstances since the agreement was
made, the terms have ceased to be reasonable;

(iii)in any other case, that the terms proposed by the Service are
unreasonable.

(3) Where a matter is referred to the Council under paragraph (2), without
prejudice to Article 14, the Council

(a)if satisfied that the grounds on which the matter was referred to it have
been established, shall notify its conclusions to the person who referred the
matter to it and the Service;

(b)if satisfied that those grounds have not been established, shall notify its
conclusions to the person who referred the matter to it.

(4) Where a person

(a)is dissatisfied with the conclusions of the Council mentioned in paragraph
(3); or

(b)where sub-paragraph (a) of paragraph (3) applies, claims that the Service
has failed to give effect to these conclusions,

(5) Where a matter is referred to the Ministry under paragraph (4), and the
Ministry is satisfied, after consultation with the Service and the Council,
that the grounds on which the matter was referred to it have been established,
the Ministry may give any advice it considers appropriate in the circumstances
to the Service.

(6) Any reference in this Article to a refusal to comply with a request
includes a reference to a failure to comply with it within a reasonable time
after the request is made.
