CONSENT ORDER
UPON the Claimant seeking the Defendant's consent to amend its Claim Form dated 31 August 2022 and Particulars of Claim dated 30 January 2023
AND UPON the Defendant consenting to the Claimant’s request to amend its Claim Form and Particulars of Claim under RDC 18.9 and 18.12, strictly without prejudice to the Defendant’s primary position that the Claimant’s unamended and amended claims have been / will be filed and served after the end of a relevant limitation period and are therefore time-barred
AND UPON the parties agreeing to the terms of this Consent Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimant is permitted to amend its Claim Form and Particulars of Claim in the form exhibited to this Order.
2. The Claimant shall pay the Defendant’s reasonable costs of and occasioned by the Amended Claim Form and Amended Particulars of Claim in any event, to be assessed if not agreed.
