CONSENT ORDER
UPON the Claimant and the Defendant having reached an agreement that the proceedings in this case shall be consolidated with two related cases
AND UPON the Claimant and the Defendant having reached an agreement to extend the time limit for filing and serving the Reply to Defence and the Defence to Counterclaim
IT IS HEREBY ORDERED BY CONSENT THAT:
1. Pursuant to Registrar’s Direction No. 2 of 2014 – Consolidation of Applications/Cases before the DIFC Courts, the following proceedings are consolidated:
(a) case number CFI-077-2021;
(b) case number CFI-078-2021; and
(c) case number CFI-081-2021.
2. The title and case number of the consolidated proceedings shall be Eshraq Investments PJSC v Mr Shehab M. Gargash & Others (CFI-077-2021).
3. The files in case numbers CFI-078-2021 and CFI-081-2021 shall be transferred to and added to the file of case number CFI-077-2021.
4. All further submissions shall be filed and served in respect of the consolidated case.
5. The Claimant shall file and serve the Reply to Defence and the Defence to Counterclaim by 4pm on 26 April 2022.
6. The Defendant may file and serve a Reply to the Defence to Counterclaim within 54 days of the Claimant’s service of the Defence to Counterclaim.
7. Any costs in relation to this Consent Order shall be borne by the Claimant and the Defendant in equal shares.
