EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations set out the circumstances in which the register of the members of an NHS foundation trust should not be made available to the public.
Regulation 2(a) provides that, if an NHS foundation trust has a patients' constituency, the details of the members who belong to that constituency must not be made available to the public in the register of members.
Regulation 2(b) provides that, where a member of an NHS foundation trust requests it, his details should not be made available to the public in the register of members. While such a request may be made for any reason, the regulation ensures consistency with section 11 of the Data Protection Act 1998.
