      ENVIRONMENTAL PROTECTION

      The Financial Assistance for Environmental Purposes (Scotland) Order 2002

        Made 5th March 2002 
        Laid before the Scottish Parliament 5th March 2002 
        Coming into force 26th March 2002 

      The Scottish Ministers, in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990[1] and of all other powers enabling them in that behalf, hereby make the following Order:

      Citation, commencement and extent
           1.  - (1) This Order may be cited as the Financial Assistance for Environmental Purposes (Scotland) Order 2002 and shall come into force on 26th March 2002.

          (2) This Order extends to Scotland only.

      Variation of section 153(1) of the Environmental Protection Act 1990
          
      2. -  Section 153(1) of the Environmental Protection Act 1990[2] (purposes for which financial assistance may be given) is varied by adding after paragraph (mm)-

            " (nn) any scheme for the storage, treatment or disposal of any material or product for the purpose of preventing or reducing environmental damage;".

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This Order varies section 153(1) of the Environment Protection Act 1990 so as to enable the Scottish Ministers to give financial assistance for the purposes of storing or treating any material or product prior to its disposal in an environmentally safe manner.
