      PUBLIC FINANCE AND ACCOUNTABILITY

      The Public Finance and Accountability (Scotland) Act 2000 (Access to Documents and Information) (Relevant Persons) Order 2002

        Made 28th February 2002 
        Laid before the Scottish Parliament 4th March 2002 
        Coming into force 1st April 2002 

      The Scottish Ministers, in exercise of the powers conferred by section 24(5) of the Public Finance and Accountability (Scotland) Act 2000[1], and of all other powers enabling them in that behalf, hereby make the following Order:

      Citation, commencement and interpretation
           1.  - (1) This Order may be cited as the Public Finance and Accountability (Scotland) Act 2000 (Access to Documents and Information) (Relevant Persons) Order 2002 and shall come into force on 1st April 2002.

          (2) In this Order, "the 2000 Act" means the Public Finance and Accountability (Scotland) Act 2000.

      Relevant persons
          
      2.  - (1) The persons and classes of person listed in Schedule 1 to this Order are specified under section 24(5) of the 2000 Act for the purpose of section 24(2) of the 2000 Act (access to documents and information for the purposes of the audit of an account under sections 21 and 22).

          (2) The persons and classes of person listed in Schedule 2 to this Order are specified under section 24(5) of the 2000 Act for the purpose of section 24(4) of the 2000 Act (access to documents and information for the purposes of an examination under section 23).

      PERSONS AND CLASSES OF PERSON SPECIFIED UNDER SECTION 24(5) OF THE 2000 ACT FOR THE PURPOSE OF SECTION 24(2) OF THE 2000 ACT


      Bodies registered as social landlords under section 57 of the Housing (Scotland) Act 2001[

      Community Learning Scotland (a company limited by guarantee registered under company number SC098117)

      Edinburgh World Heritage Trust

      Forward Scotland Limited (a company limited by guarantee registered under company number SC129402)

      Glasgow West Conservation Trust

      Hannah Research Institute

      Higher education institutions, being institutions designated under section 44(2) of the Further and Higher Education (Scotland) Act 1992[3]

      Learning and Teaching Scotland (a company limited by guarantee registered under company number SC200241)

      Local enterprise companies, being companies with whom there is in force an agreement which has been made in pursuance of section 19 of the Enterprise and New Towns (Scotland) Act 1990[4] by Scottish Enterprise or Highlands and Islands Enterprise for the discharge by the company of any of the functions of Scottish Enterprise or, as the case may be, Highlands and Islands Enterprise.

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This order specifies persons and classes of person in relation to whom the Auditor General for Scotland is entitled to have access to documents or information for the purposes of conducting an audit or an economy, efficiency and effectiveness examination under the Public Finance and Accountability (Scotland) Act 2000.

      The persons and classes of person specified in Schedule 1 to the Order are specified for the purposes of an audit. The persons and classes of person specified in Schedule 2 to the Order are specified for the purposes of an economy, efficiency and effectiveness examination.
