      CONTAMINATION OF FOOD

      The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Partial Revocation (No. 4) Order 2000

        Made 16th November 2000 
        Laid before the Scottish Parliament 20th November 2000 
        Coming into force in accordance with article 1

      The Scottish Ministers, in exercise of the powers conferred by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 1985[1], and of all other powers enabling them in that behalf, hereby make the following Order:

      Citation and commencement
           1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Partial Revocation (No. 4) Order 2000 and shall come into force at 1400 hours on 16th November 2000.

      Interpretation
          
      2. In this Order "the principal Order" means the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000[2].

      Partial Revocation of the principal Order
           3. The principal Order is revoked insofar as it designates any part of Areas A, B and C described in the Schedule to this Order being areas within Area 1 described in the Schedule to the principal Order.

      Area A
      The area of sea below high water springs enclosed by a line starting from a point at 57° 30'North latitude 7° 00'West longitude; then north to a point on South Harris at 57° 45'North latitude 7° 00'West longitude; then south and east along the shore of South Harris to a point at 57° 45'North latitude 6° 56'West longitude; then east to a point at 57° 45'North latitude 6° 00'West longitude; then south to a point on Eilean Garbh at 57° 32.5'North latitude 6° 00'West longitude; then west along the shore to a point at 57° 31.9'North latitude 6° 00'West longitude; then south to 57° 30.9'North latitude 6° 00'West longitude on Eilean Tigh; then west and south along the shore to a point at 57° 30.5'North latitude 6° 00' West longitude; then south to a point at 57° 30'North latitude 6° 00'West longitude; then west to a point on the Isle of Skye at 57° 30'North latitude 6° 00'West longitude; then north, west and south along the Skye shore to a point at 57° 30'North latitude 6° 45'West longitude; then west to the point of beginning.

      The area of sea below high water springs enclosed by a line starting from a point 57° 00'North latitude 6° 30'West longitude; then north to a point on the island of Sanday at 57° 02.8'North latitude 6° 30'West longitude; then around the east coast of Sanday to a point at 57° 03'North latitude 6° 30'West longitude; then north to a point on the island of Canna, at 57° 03.3'North latitude 6° 30'West longitude; then along the east coast of Canna to a point at 57° 04.1'North latitude 6° 30'West longitude; then north to a point on the Isle of Skye at 57° 23'North latitude 6° 30'West longitude; then east and south along the west coast of Skye to a point at 57° 11'North latitude 6° 00'West longitude; then south to a further point on the west coast of Skye at 57° 07'North latitude 6° 00'West longitude; then south to a further point on the west coast of Skye at 57° 01'North latitude 6° 00'West longitude; then south to 57° 00'North latitude 6° 00'West longitude; then west to a point on the island of Rhum at 57° 00'North latitude 6° 14'West longitude; then west along the north shore of Rhum to a point at 57° 00'North latitude 6° 27'West longitude; then west to the point of beginning.

      Area C
      The area of sea below high water springs enclosed by a line starting from a point at 56° 45'North latitude 7° 00'West longitude; then north to 57° 00'North latitude 7° 00'West longitude; then east to 57° 00'North latitude 6° 30'West longitude; then south to a point on the island of Coll at 56° 40.1'North latitude 6° 30'West longitude; then east along the shore to a point at 56° 37'North latitude 6° 30'West longitude; then south to a point at 56° 30'North latitude 6° 30'West longitude; then west to a point on the island of Tiree at a point at 56° 30'North latitude 6° 49'West longitude; then east, north and west along the Tiree shore to a point at 56° 30'North latitude 6° 58.5'West longitude; then west to at point 56° 30'North latitude 7° 00'West longitude; then north to the point of beginning.

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This Order is the fourth partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000 (S.S.I. 2000/291) ("the principal Order") which prohibited-

        (a) fishing for or taking scallops within the areas designated in the Schedule to that Order (article 4 of the principal Order);

        (b) movement of such scallops out of these areas (article 5 of the principal Order); and

        (c) landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated areas (article 6 of the principal Order).

      The effect of this Order is to remove the prohibitions in respect of the areas of sea designated in the Schedule to this Order, which form part of the area of sea designated as Area 1 in the Schedule to the principal Order.
