CHILDREN AND YOUNG PERSONS ACT (NORTHERN IRELAND) 1968 - SECT 159



159.(1) If no affiliation order is in force with respect to any child or
young person to whom this section applies, [the Ministry of Home Affairs] ...,
may, subject to the provisions of subsection (2), make application upon
complaint to a justice of the peace having jurisdiction in the place where
either the mother or the putative father of the child or young person resides
for a summons to be issued under section 2 of the Act of 1924. [The Ministry]
... making an application under this subsection is in this section referred to
as "the applicant".

(2) Notwithstanding anything in any enactment limiting the time within which
application may be made for an affiliation order, an application under
subsection (1) may be made

(a)in respect of a person received into the care of [the Ministry of Home
Affairs] under section 103, within three years from the time when he was
received or last received into the care of that [Ministry] ...;

(b)in respect of a child or young person

(i)committed to the care of [the Ministry] as a fit person; or

(ii)ordered to be sent to a training school ...;

(b)within three years from the coming into force of the relevant order;

(3) In any proceedings on an application under this section the court shall
hear such evidence as the applicant may produce, in addition to the evidence
required to be heard by section 1(3) of the Act of 1924, and shall in all
other respects, but subject to the provisions of subsection (4), proceed as on
an application made under the said section 2.

(4) An order made on an application under this section may, notwithstanding
anything in section 3(3) of the Act of 1924, be made so as to provide that the
payments or a part of the payments to be made thereunder shall be made to
the applicant or to such other person as the court may direct.
