The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by sections 75 and 104(1) of the New Roads and Street Works Act 1991[
1], and now vested in them[
2], make the following regulations:
Title, commencement and application
1.
The title of these Regulations is the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2007. They come into force on 10 July 2007 and apply in relation to Wales.
Preliminary
2.
The Street Works (Inspection Fees) (Wales) Regulations 2006[
3] are amended as follows.
Amendment to regulation 3 (inspection fees)

In regulation 3, in paragraphs (1) and (8), for "£21.00" substitute "£24.00".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Street Works (Inspection Fees) (Wales) Regulations 2006 so as to increase the fee payable by undertakers for inspections of their work by street authorities in Wales under regulation 3 of those Regulations.
The fee for such inspections, which was last altered in April 2004, is increased by 14.3% from £21 to £24.
A Regulatory Impact Assessment has been prepared in respect of these regulations. This is available for inspection at the offices of Transport Wales, Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.

The functions of the Secretary of State under sections 75 and 104(1) were transferred, so far as exercisable in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1. Section 75 is prospectively substituted by section 58(2) of the Traffic Management Act 2004 (c.18). The functions of the National Assembly for Wales under the said sections 75 and 104(1) were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006.back
