The Secretary of State makes these Regulations in exercise of the power conferred by section 2(1) of the Northern Ireland (Executive Formation etc) Act 2022( 1).
1.—(1) These Regulations may be cited as the Northern Ireland (Extension of Period for Making Ministerial Appointments) Regulations 2022.
(2) They come into force on 8th December 2022.
(3) They extend to England and Wales, Scotland, and Northern Ireland.
2.—(1) The Northern Ireland (Executive Formation etc) Act 2022 is amended as follows.
(2) In section 1(1), for “8 December 2022” substitute “19 January 2023”.

Section 1 of the Northern Ireland (Executive Formation etc) Act 2022 (c. 48)(“ the 2022 Act”) extended the time under section 16A of the Northern Ireland Act 1998 (c. 47)for Northern Ireland Ministers to be appointed, following the Assembly elections that took place on 5th May 2022, until 8th December 2022. Section 2(1) of the 2022 Act allows the Secretary of State, by regulations, to extend that period for a further six-week period up to and including 19th January 2023.
These Regulations extend the period for the appointment of Northern Ireland Ministers until 19th January 2023.
Section 2(2)(a) of the 2022 Act enables these Regulations to be made before, on or after 8th December 2022.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
