The Secretary of State for Education makes the following Order in exercise of the powers conferred by sections 16(1)(a) and (5) and 17(2)(b) of the Further and Higher Education Act 1992(1).
1. This Order may be cited as the National College for the Creative and Cultural Industries (Incorporation) Order 2016 and comes into force on 1st September 2016.
2. There is established a body corporate called "the National College for the Creative and Cultural Industries", for the purpose of establishing and conducting as from the operative date a new educational institution of that name.
3. The operative date in relation to the further education corporation established by this Order is 2nd September 2016.

This Order establishes a further education corporation called "the National College for the Creative and Cultural Industries" under section 16(1)(a) of the Further and Higher Education Act 1992 for the purpose of conducting a new educational institution called by the same name. It appoints 2nd September 2016 as the operative date for the purposes of Part 1 of the Act, being the date from which the further education corporation shall operate the college.
An Impact Assessment has not been prepared for this instrument as it has no wider impact on the costs of business, charities or voluntary bodies. The impact on the public sector is minimal. The Explanatory Memorandum is published alongside the Order at www.legislation.gov.uk.
Section 16A was inserted by the Education Act 2011 (c.21) Schedule 12.
