Coming into force in accordance with article 1
1. This Instrument may be cited as The Sunderland City Council (Sunderland Strategic Transport Corridor -“ New Wear Bridge) Scheme 2009 Confirmation Instrument 2012 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
2. The Sunderland City Council (Sunderland Strategic Transport Corridor -“ New Wear Bridge) Scheme 2009 Confirmation Instrument 2012 ("the Scheme") is hereby confirmed with modifications.
3. The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA, and at the offices of Sunderland City Council at Civic Centre, Sunderland, SR2 7DN.

The Council of the City of Sunderland ("the Council") make this Scheme in exercise of their powers under Section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:-
1. The Council are authorised to construct over the navigable waters of the River Wear the bridge specified in the Schedule to this Scheme as part of the highway which they are proposing to construct/improve between the Wessington Way/Castletown Way roundabout and the Woodbine Terrace/Pallion New Road junction in the City of Sunderland.
2. This Scheme may be cited as The Sunderland City Council (Sunderland Strategic Transport Corridor -“ New Wear Bridge) Scheme 2009.

The location and general design of the Bridge are shown on the plans numbered 8132/100 and 8132/101 marked The Sunderland City Council (Sunderland Strategic Transport Corridor -“ New Wear Bridge) Scheme 2009.
POINTS OF COMMENCEMENT AND TERMINATION
From a point on the South Bank of the River Wear 155 metres east of the centre of the roundabout junction between A1231 Wessington Way and Castletown Way located on the north bank.
To a point on the North Bank of the River Wear 30 metres east of the centre of the roundabout junction between A1231 Wessington Way and Castletown Way.
SPAN
A double span of 336 metres overall.
HEADWAY
Not less than 12.9 metres above the mean high water spring tide level (MHWS) of 2.5 metres AOD.
WATERWAY
A minimum clear navigable waterway of 30 metres.
OVERALL DIMENSIONS
The Bridge will be 25.2 metres wide overall and will carry a dual 7.3 metre wide carriageway with a 1.8 metre central reserve with a footway of 2 metres width on the east side, separated from the carriageway by a 1 metre median, and a footway and cycleway of 4 metres width on the west side of the structure, separated from the carriageway by a 1 metre median.

This instrument confirms a scheme to construct over the navigable waters of the River Wear a bridge as part of the highway which is to be constructed/improved between the Wessington Way/Castletown Way roundabout and the Woodbine Terrace/Pallion New Road junction in the City of Sunderland.
The Secretary of State has modified this scheme as follows: Under "SPAN" the word "plan" has been amended to "span".
