The Secretary of State[
1], makes the following Order in exercise of the powers conferred by sections 95, 96 and 123 of the Local Government Act 2003[
2].
Citation and commencement
1.
This Order may be cited as the Local Government (Best Value Authorities) (Power to Trade) (England) (Amendment No.2) Order 2007 and shall come into force on 29th September 2007.
Amendment of the Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004
2.
—(1) The Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004[
3] is amended as follows.
(2) In article 4(2) for "30th September 2007" substitute "30th September 2009".

EXPLANATORY NOTE
(This note is not part of the Order)
Article 2 of this Order amends article 4 of the Local Government (Best Value Authorities) (Power to Trade) (England) Order 2004 (the 2004 Order). It extends the transitional period for the fire and rescue authorities specified in the Schedule to the 2004 Order to exercise the power to trade under section 95 of the Local Government Act 2003 from 30th September 2007 to 30th September 2009.
