The Treasury are a government department designated[
1] for the purposes of section 2(2) of the European Communities Act 1972[
2] in relation to measures relating to (i) the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States, and (ii) the movement of capital and to payments, between Member States and between Member States and countries which are not Member States;
The Treasury, in exercise of the powers conferred upon them by that section, hereby make the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Liberia (Freezing of Funds and Economic Resources) (Amendment No.2) Regulations 2004 and shall come into force on 2nd October 2004.
Revocation
2.
The Liberia (Freezing of Funds and Economic Resources) (Amendment) Regulations 2004[
3] shall be revoked.
Amendment of the Liberia (Freezing of Funds and Economic Resources) Regulations 2004
3.
For the definition of "the EC Regulation" in regulation 1(2) of the Liberia (Freezing of Funds and Economic Resources) Regulations 2004[
4], substitute -
"
"the EC Regulation" means Council Regulation (EC) No 872/2004 of 29th April 2004 concerning the freezing of funds of former Liberian President Charles Taylor and certain persons and entities associated with him[5],as amended by -
(a) Commission Regulation (EC) No 1149/2004 of 22 June 2004 amending Council Regulation (EC) No 872/2004 concerning further restrictive measures in relation to Liberia [6],
(b) Commission Regulation (EC) No 1478/2004 of 18 August 2004 amending Council Regulation (EC) No 872/2004 concerning further restrictive measures in relation to Liberia[7], and
(c) Commission Regulation (EC) No 1580/2004 of 8 September 2004 amending Council Regulation (EC) No 872/2004 concerning further restrictive measures in relation to Liberia[8].".

EXPLANATORY NOTE
(This note is not part of the Regulations)
Council Regulation (EC) No 872/2004 of 29 April 2004 ("the Council Regulation") imposes a freeze on the funds and economic resources of former Liberian President Charles Taylor and certain other persons associated with him as designated by the Committee established by paragraph 21 of UN Security Council Resolution 1521 (2003) ("the UN Sanctions Committee") and listed in Annex I to that Regulation.
The Liberia (Freezing of Funds and Economic Resources) Regulations 2004 provide that breaches of certain provisions of the Council Regulation, and certain other acts and omissions, are criminal offences. SI 2004/1710 amended the definition of "the EC Regulation" in regulation 1(2) of those regulations so that it referred to the EC Regulation as amended by Commission Regulation (EC) No 1149/2004 of 22 June 2004.
The UN Sanctions Committee subsequently amended the identifying information relating to certain designated targets. Accordingly the Commission, by Regulation (EC) No 1478/2004 of 18 August 2004, updated the identifying information in Annex I of the Council Regulation.
Most recently on 25 and 26 August 2004 the UN Sanctions Committee decided to add three additional persons to the list of designated targets and amended the identifying information for one listed person. Commission Regulation (EC) No 1580/2004 of 8 September 2004 accordingly extends and amends the list of persons subject to restrictive measures in Annex I of the Council Regulation.
The present Regulations amend the Liberia (Freezing of Funds and Economic Resources) Regulations 2004 so that they refer to the Council Regulation as further amended by Commission Regulation (EC) No 1478/2004 and Commission Regulation (EC) No 1580/2004.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
