Whereas the Treasury are a government department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to (i) measures relating to the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States, and (ii) measures relating to the movement of capital and to payments, between Member States and between Member States and countries which are not Member States;
Now, therefore, the Treasury, in exercise of the powers conferred on them by that section, hereby make the following Regulations:
Citation and commencement

These Regulations may be cited as the Burma (Freezing of Funds) (Amendment) Regulations 2003 and shall come into force on 6th August 2003.
Amendment of the Burma (Freezing of Funds) Regulations 2000
2.
At the end of regulation 1(2)(b) of the Burma (Freezing of Funds) Regulations 2000[3], there is added ", as amended by Commission Regulation (EC) No. 744/2003 of 28th April 2003[4] and Commission Regulation (EC) No. 1070/2003 of 20th June 2003[5]".

EXPLANATORY NOTE
(This note is not part of the Regulations)
Council Regulation (EC) No. 1081/2000 of 22nd May 2000 provided, among other matters, for a freeze on the funds of certain persons related to important governmental functions in Burma/Myanmar, and their families. These persons were listed in Annex II to that Regulation, and an amended version of that Annex was substituted in October 2002. Commission Regulation (EC) No. 1070/2003 of 20th June 2003 substituted a further revised version of Annex II in place of the earlier replacement.
Meanwhile, Commission Regulation (EC) No. 744/2003 of 28th April 2003 had amended Annex III to the Council Regulation, which lists relevant address details for the European Commission and the competent authorities of the Member States.
The Burma (Freezing of Funds) Regulations 2000 provide that breaches of certain provisions of Council Regulation 1081/2000, and certain other acts and omissions, are to be criminal offences. The present Regulations amend those Regulations so that they refer to Council Regulation 1081/2000 as amended by Commission Regulations 744/2003 and 1070/2003.
