In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998(1) the Secretary of State for Education and Employment hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Amendment) (England) Regulations 1999 and shall come into force on 1st September 1999.
2. The Education (Induction Arrangements for School Teachers) (England) Regulations 1999(2) shall be amended as follows.
3. In the definition of "non-maintained special school" in regulation 2(1) the words "a maintained special school, a grant-maintained special school," shall be omitted.
4.-(1) For paragraph (a) of regulation 4 there shall be substituted the following paragraph-
"(a)the appropriate body in relation to a community, foundation or voluntary school, a community or foundation special school, or a maintained nursery school (in each case within the meaning of the 1998 Act) is the authority maintaining it;".
(2) In regulation 4(c)(ii) there shall be inserted before the word "body" wherever it occurs the words "person or".
5. In paragraph 7 of Schedule 1 there shall be inserted after the word "has" the words ", or is eligible for,".
6. Sub-paragraph (b) of paragraph 9 of Schedule 1 and the word "and" preceding it shall be omitted.

These Regulations amend the Education (Induction Arrangements for School Teachers) (England) Regulations 1999. Under the School Standards and Framework Act 1998 the new framework for schools takes effect on 1st September 1999 and consequently references to schools in the old school framework become spent on that day and are removed. Regulation 4 is amended to enable the Secretary of State to designate a person (as well as a body) as the appropriate authority in relation to independent schools providing induction. The provisions relating to teachers from Scotland and from EEA countries falling within Article 3 of Council Directive 89/48 EEC (O.J. No. L19, 24.1.89, p. 16) in paragraphs 7 and 9 of Schedule 1 are amended.
