(This note is not part of the Regulations)
These Regulations make provision whereby the Secretary of State may approve standards of safety for the purposes of section 10(3) of the Consumer Protection Act 1987. Under section 10(3), consumer goods are not to be regarded as failing to comply with the general safety requirement (section 10(1) and (2)) in respect of, inter alia, any failure to do more in relation to any matter than is required by any standards of safety approved for the purposes of the subsection by or under regulations made under section 11 and imposing requirements with respect to that matter.
The Regulations provide in particular that the Secretary of State may approve, or cancel any approval of, a standard of safety (regulation 2); that an approval or cancellation is to be effected by the publication of a notice by the Secretary of State specifying the approval or cancellation and the place where the relevant standard may be obtained (regulation 3); and that the Secretary of State is to keep a register of approvals given under the Regulations (regulation 6).
It is intended that notices of approvals and cancellations will be published in British Business and BSI News; and that the register of approvals will be made available for public inspection at The Library, Department of Trade and Industry, 1 Victoria Street, London SW1H 0ET.
