ESTATE AGENTS

The Secretary of State, in exercise of the powers conferred on him by section 36(2) of the Estate Agents Act 1979 and of all other powers enabling him in that behalf, hereby makes the following Order:-
1. This Order may be cited as the Estate Agents Act 1979 (Commencement No. 1) Order 1981.
2. Sections 1 to 15, 18, 20, 21, 23 to 34 and 36 of, and Schedules 1 and 2 to, the Estate Agents Act 1979 shall come into operation on 3rd May 1982.

This Order brings into operation on 3rd May 1982 most of the provisions of the Estate Agents Act 1979 including:-
1. Sections 1 to 15 and Schedules 1 and 2 relating to the application of the Act, Orders by the Director General of Fair Trading, information, entry and inspection and clients' money and accounts other than insurance cover for clients' money.
2. Section 18 relating to information to be given to clients about their prospective liabilities to estate agents.
3. Section 20 prohibiting pre-contract deposits in Scotland.
4. Section 21 relating to transactions in which an estate agent has a personal interest.
5. Section 23 prohibiting bankrupts from engaging in estate agency work.
6. Sections 24 to 34 and 36 relating to supervision, enforcement, publicity and supplementary matters.
