Summary
The decision concerns a request for confidentiality of a large number of
documents that had been filed in the entitlement proceedings.
The Hearing Officer considered that it was unlikely that some of the documents would form part of the substantive decision in this case. He decided that this was a good reason for treating those documents (only) as confidential.
In view of the “good reason” accepted for directing confidentiality, the Hearing Officer indicated that if one or more of the ‘confidential’ documents were to form part of a subsequent decision in these proceedings, then the Comptroller would consider whether this direction should be revoked - at least in relation to the document(s) concerned.
