Summary
Following initiation of revocation proceedings, the parties agreed to settle their dispute and the applicant for revocation withdrew unconditionally from the proceedings. Following long-standing practice, the hearing officer went on to consider whether the notice of withdrawal should be accepted or whether there were questions needing further consideration in the public interest. Having construed claim 1 of the patent, the hearing officer concluded that a case for revocation had not been made out and so made no order for the revocation of the patent.
