The complainant has requested from NHS England information relating to the Independent Review of Gender Identity Services for Children and Young People also known as the Cass review (the review). NHS England applied section 14(1) of FOIA (vexatious request) to refuse the three requests in this case. The Commissioner's decision is that the requests were not vexatious and therefore NHS England was not entitled to rely on section 14(1) to refuse them. The Commissioner requires NHS England to issue a fresh response to the requests that does not rely on section 14(1) of FOIA.
