Applicant's case was that the property had been transferred temporarily into his partner's sole name to put it beyond the reach of a possible creditor for the duration of some personal injury litigation, the agreement being that it would be then be put back into joint names. Claim rejected, but indicated that had it succeeded, relief would have been refused in any event applying Gascoyne v. Gascoyne, Tinker v. Tinker and Patel v. Mirza |
