Decision notes | [2018] UKFTT 722 (PC). Application for adverse possession based on two years possession after an earlier application had been rejected. Applicant accepted he had not been in possession for much of the two years. He relied upon the fact that a company of which he was sole director and shareholder had the property as its registered address. There was no suggestion that the company had any chattels in the property, which the registered proprietors were busy refurbishing. The company was struck off and dissolved under s.1000(3) Companies Act as it was not active. HELD that the mere fact that the company had the property at its registered address was not on the facts possession of the property. Application cancelled. |
