"A complaint may be presented to an [employment tribunal] against an employer by any person that he was unfairly dismissed by the employer."
and at sub section (2) (missing out the irrelevant words):
"….an [employment Tribunal] shall not consider a complaint under this section unless, it is presented to the tribunal –
(a) before the end of the period of three months beginning with the effective date of termination, or
(b) within such further period as the tribunal considers reasonable in a case where it is satisfied that it was not reasonably practicable for the complaint to be presented before the end of that period of three months."
"The evidence shows that the Applicant was at home between 8 May 1999 and August 1999, regaining his strength and towards the end of that period he would have been fit enough to submit an application to the Tribunal. Also after another period of a few days in hospital, he was then discharged on 31 August 1999 and the evidence shows that within a few weeks of that date he would have been fit enough to present a claim to the Tribunal.. Given that the claim was not presented until 10 December 1999, the claim has not been presented within a reasonable period after the prescribed period of 3 months. Accordingly, the claim is out of time and must be dismissed."
