THE INDUSTRIAL TRIBUNALS
CASE REF: 5598/17
CLAIMANT: Alan McLaughlin
RESPONDENT: Phillip Greer, t/a PG Joinery
DECISION
The decision of the tribunal is that the respondent is ordered to pay to the claimant a redundancy payment of £4,293.14 and an award of £1,040.76 for failing to provide a written statement of his main terms and conditions of employment.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Greene
Appearances:
The claimant appeared in person.
The respondent was represented by Mr Phillip Greer.
1. The claimant brought a claim for a redundancy payment.
2. In its response the respondent indicated that he did not intend to resist the claim.
3. Accordingly on 9 November 2017 I issued a Default Judgement in relation to liability only in the claimant's favour.
4. The remedy hearing came on for hearing on today 14 December 2017.
5. On the basis of the evidence before me I am satisfied that the claimant is entitled to a redundancy payment of £4,293.14.
6. It emerged in the course of the evidence that the claimant had not been provided with his main terms and conditions of employment in writing when he began employment with the respondent or indeed during that employment. I am therefore satisfied that the claimant is entitled to payment of £1,040.76 against the respondent for his failure to provide written terms and conditions of employment.
7. Reasons for my decision were given at the hearing.
8. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
