THE INDUSTRIAL TRIBUNALS
CASE REF: 2757/14
CLAIMANT: Jonathan Mooney
RESPONDENT: Fairhaven Residential Home Ltd
DECISION
The unanimous decision of the tribunal is that this was a technically unfair dismissal and that the basic award of four weeks’ gross pay totalling £883.40 is made in this case. However, the tribunal unanimously concludes that the claimant had completely contributed to his own dismissal and that a dismissal was, in any event, absolutely inevitable if the correct procedure had been followed. Therefore, no further award is made.
Constitution of Tribunal:
Vice President: Mr N Kelly
Members: Professor D Boyd
Mrs A Gribben
Appearances:
The claimant appeared in person and was not represented.
The respondent was represented by Ms E Orr, of the respondent company.
1. The decision was given orally with reasons at the conclusion of the hearing.
2. The tribunal calculated an average of 35 hours per week at an hourly rate of £6.31 per hour, which totalled an average weekly pay of £220.85 (gross). The four weeks basic minimum award is therefore £883.40.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
