CASE REF: 142/07
CLAIMANT: Joan Jackson
RESPONDENTS: 1. Les Hopson
2. Mark Daniels
3. Bow Street Mall Ltd
The unanimous decision of the tribunal is that by consent the third respondent is ordered to pay to the claimant two days' notice pay, totalling £92.45; five days' holiday pay, totalling £231.04; and £924.16, being four weeks' pay, by way of penalty for failing to provide the claimant with the statement of her terms and conditions of employment. The tribunal considered that the imposition of the maximum penalty was appropriate in the circumstances of this case, there being no acceptable reason for failure to provide the terms and conditions. The third respondent therefore is ordered to pay a total amount of £1247.65 to the claimant if it has not already done so. The tribunal orders that the first and second respondents be dismissed from the proceedings.
