I, LIAM KAVANAGH, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, with the consent of the Minister for Communications, order as follows: |

1. This Order may be cited as the Aquaculture (Ballynakill) Order, 1986. |
||
2. The area described in the Schedule hereto is hereby designated to be an area within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980). |

SCHEDULE |
||
All that area of Ballynakill Harbour and adjoining waters which is bordered by the high water mark and which is enclosed by a line drawn in a westerly direction from the most westerly point of the high water mark of the townland of Gannoughs, barony of Ballynahinch, county of Galway, to the most westerly point of the high water mark of High Island, barony of Ballynahinch, county of Galway, and thence continuing in a north-easterly direction to the most northerly point of the high water mark of Crump Island, barony of Ballynahinch, county of Galway, and thence continuing in an easterly direction to the most northerly point of the high water mark of the townland of Culfin, barony of Ballynahinch, county of Galway. |
