Coming into force in accordance with regulation 1

The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the environmental aspects of product design and makes these Regulations in exercise of the powers conferred by that section.

Citation and commencement

1.-(1) These Regulations may be cited as the Ecodesign for Energy-Related Products and Energy Information (Amendment) Regulations 2012.

(2) Subject to paragraph (3), these Regulations come into force on 1st January 2013.

(3) Regulation 3(3) comes into force on 29th September 2013.

Amendment of the Ecodesign for Energy-Related Products Regulations 2010

2.-(1) The Ecodesign for Energy-Related Products Regulations 2010(3) are amended as follows.

(2) In Schedule 1 (declaration of conformity) in the table at paragraph 4 after item 12 insert-

"13A water pumpCommission Regulation (EU) No 547/2012 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to ecodesign requirements for water pumps(4)
14An air conditioner or a comfort fanCommission Regulation (EU) No 206/2012 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to ecodesign requirements for air conditioners and comfort fans(5)".

Amendment of the Energy Information Regulations 2011

3.-(1) The Energy Information Regulations 2011(6) are amended as follows.

(2) In the table at Schedule 1 (EU measures) for the entry relating to air-conditioners substitute-

"Air conditionersCommission Delegated Regulation (EU) No 626/2011 supplementing Directive 2010/30/EU of the European Parliament and of the Council with regard to energy labelling of air conditioners(7)1st January 2013".

(3) In the table at Schedule 1 (EU measures) for the entry relating to tumble driers substitute-

"Household tumble driersCommission Delegated Regulation (EU) No 392/2012 supplementing Directive 2010/30/EU of the European Parliament and of the Council with regard to energy labelling of household tumble driers(8)29th September 2013".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments to the Ecodesign for Energy-Related Products Regulations 2010 (S.I. 2010/2617) and the Energy Information Regulations 2011 (S.I. 2011/1524) and partially implement four EU Commission Regulations as follows-

(a)regulation 2 inserts additional products (water pumps, air conditioners and comfort fans) into the table in Schedule 1 (declaration of conformity) to the Ecodesign for Energy-Related Products Regulations 2010;

(b)regulation 3(2) substitutes the reference to air conditioners in Schedule 1 (EU measures) to the Energy Information Regulations 2011; and

(c)regulation 3(3) substitutes, from 29th September 2013 the reference to household tumble driers in Schedule 1 (EU measures) to the Energy Information Regulations 2011.

A full impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
