Coming into force in accordance with article 1

In the referendum held under section 1 of the Parliamentary Voting System and Constituencies Act 2011(1), more votes were not cast in favour of the answer "Yes" than in favour of the answer "No".

Accordingly, the Lord President of the Council(2), in performance of the obligation imposed by section 8(2) of the Parliamentary Voting System and Constituencies Act 2011, makes the following Order:

Citation and commencement

1. This Order may be cited as the Parliamentary Voting System and Constituencies Act 2011 (Repeal of Alternative Vote Provisions) Order 2011 and comes into force on the day after the day on which it is made.

Repeal of alternative vote provisions

2. In the Parliamentary Voting System and Constituencies Act 2011, the following are repealed-

(a)section 9 (the alternative vote system: amendments),

(b)Schedule 10 (the alternative vote system: further amendments), and

(c)Part 1 of Schedule 12 (repeals: voting system for parliamentary elections).

EXPLANATORY NOTE

(This note is not part of the Order)

Under section 1 of the Parliamentary Voting System and Constituencies Act 2011 ("the 2011 Act"), a referendum was held on 5 May 2011 on the voting system for parliamentary elections.

More votes were cast in favour of continuing to use the "first past the post system" than in favour of using the "alternative vote" system instead.

Accordingly, under section 8(2) of the 2011 Act the Minister is obliged to make an order repealing section 9 of, and Schedule 10 and Part 1 of Schedule 12 to the 2011 Act. These are the provisions in the 2011 Act that would have been necessary to give effect to the alternative vote system at parliamentary elections.

This Order repeals these provisions with effect from the day after the day on which the Order is made.

"The Minister" is defined in section 7(1) of the Parliamentary Voting System and Constituencies Act 2011 to include the Lord President of the Council.
