ROAD TRAFFIC
The Road Traffic (Vehicle Testing) Act 1999 (Commencement No. 2) Order 2003
The Secretary of State for Transport, in exercise of the powers conferred by section 9 of the Road Traffic (Vehicle Testing) Act 1999[1], hereby makes the following Order:
Citation
1.
This Order may be cited as the Road Traffic (Vehicle Testing) Act 1999 (Commencement No. 2) Order 2003.
Provisions coming into force on 11th April 2003
2.
Section 1 of the Road Traffic (Vehicle Testing) Act 1999 (in so far as it is not already in force[2]), sections 2, 4 and 5 of that Act, and so much of section 7 of that Act as relates to paragraph 3 of the Schedule to that Act, shall come into force on 11th April 2003.

EXPLANATORY NOTE
(This note is not part of the Order)
Article 2 of this Order brings into force on 11th April 2003 the remainder of section 1 of the Road Traffic (Vehicle Testing) Act 1999, sections 2, 4 and 5 of that Act, and so much of section 7 of that Act as relates to paragraph 3 of the Schedule to that Act.
Of the provisions brought into force by this Order -
(a) subsections (1) and (2) of section 1 amend subsections (3) and (4), respectively, of section 45 of the Road Traffic Act 1988 ("the 1988 Act"), which relates to the testing of the satisfactory condition of motor vehicles;
(b) section 2 substitutes section 46 of the 1988 Act, which specifies matters for which provision may be made in regulations under section 45;
(c) section 4 inserts section 46B into the 1988 Act. The new section deals with evidence from records maintained under section 45(6B) of vehicle examinations under section 45;
(d) section 5 amends section 66 of the 1988 Act, which relates to the making of regulations about vehicle excise licensing; and
(e) the partial commencement of section 7 gives effect to the consequential amendment set out in paragraph 3 of the Schedule to the Road Traffic (Vehicle Testing) Act 1999. The effect of the amendment is to substitute section 177 of the 1988 Act. The new section creates offences relating to the impersonation of persons authorised to check and seal speed limiters or to carry out examinations of vehicles under section 45 of that Act.
