The Secretary of State in pursuance of section 26(8)(c) of the Political Parties, Elections and Referendums Act 2000(1) hereby makes the following Order:
1. This Order may be cited as the Registered Parties (Non-constituent and Non-affiliated Organisations) Order 2000 and shall come into force on 14th December 2000.
2. The organisations specified in Part I of the Schedule to this Order and the organisations of a description specified in Part II of that Schedule are hereby specified as falling within section 26(8) of the Political Parties, Elections and Referendums Act 2000 (organisations which are not constituent or affiliated organisations in relation to a party for the purposes of schemes falling within section 26).

Any organisation which is not a permissible donor by virtue of coming within paragraph (b), (e), (f) or (h) of section 54(2) of the Political Parties, Elections and Referendums Act 2000.
Any branch of a students' organisation which is wholly or mainly funded from resources provided by a students' union within the meaning of Part II of the Education Act 1994(2), and defined by section 20 of that Act.

Section 26(1) of the Political Parties, Elections and Referendums Act 2000 prohibits the registration of a party unless it has adopted a scheme which sets out the arrangements for regulating its financial affairs for the purposes of that Act. The scheme must, in particular, determine whether the party is to be taken to consist of a central organisation with one or more separate accounting units, as distinct from a single organisation (section 26(2)(b)). "Accounting unit" is defined by section 26(11)(a), by reference to section 26(2)(b), as a constituent or affiliated organisation each of which is to be responsible for its own financial affairs.
Section 26(8) lists organisations which are not to be taken as a constituent or affiliated organisation in relation to a party. This Order exercises the power in section 26(8)(c) to specify organisations falling within this provision and descriptions of organisations.
