Case No. FT/D/2025/0346

Decision given on: 27 June 2025

In the First-tier Tribunal

(General Regulatory Chamber)

Transport

Before:                   Judge Alexandra Marks CBE

Appellant:             Kieren Bill

Respondent(s):     Driver and Vehicle Standards Agency

Further Case Management Directions

It is ordered that:-

The Appellant's appeal is struck out under Rule 8(3)(c) of The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 because the Tribunal considers that there is no reasonable prospect of the Appellant's case succeeding.

REASONS

1.     On 23 March 2025 the Appellant sought to appeal the decision dated 13 March 2025 of the Registrar of Approved Driving Instructors to refuse the Appellant's trainee licence application. However, on 21 May 2025, the Appellant for the third time failed the instruction ability test and thus no further trainee licence can be granted under Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005.

2.     Because it would be illegal for the Appellant to give any further instruction for reward or payment under a trainee licence, the Tribunal has no power to allow the appeal.

Signed: Judge Alexandra Marks CBE

Date: 24 June 2025
