Case No. FT/D/2024/0729 Decision given on: 27 June 2025 |

In the First-tier Tribunal (General Regulatory Chamber) Transport
|
Before: Judge Alexandra Marks CBE
Appellant: Lyndon James
Respondent(s): Driver and Vehicle Standards Agency
Further Case Management Directions
It is ordered that:-
The Appellant's appeal is struck out under Rule 8(1) of The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 because the Appellant has failed to comply with a direction that stated that failure to comply would lead to the striking out of the proceedings.
REASONS
1. On 19 August 2024 the Appellant sought to appeal the decision dated 13 August 2024 of the Registrar of Approved Driving Instructors to refuse his trainee licence application. However, at the Appellant's third attempt, on 4 October 2024, he passed part 3 of the instruction ability test and therefore no longer requires a trainee licence.
2. By Case Management Directions dated 3 January 2025, the Tribunal invited the Appellant to withdraw his appeal as the reason he submitted it no longer applies. The Tribunal advised the Appellant that if he did not respond by 17 January 2025, the Tribunal would consider that the Appellant no longer wished to pursue his appeal and might strike it out for failure to comply with the directions.
3. The Appellant did not respond by 17 January 2025 or at all, hence these proceedings are automatically struck out under Rule 8(1).
