Case No. FT-PEN-2024-0371

Decision given on: 03 June 2025

In the First-tier Tribunal

(General Regulatory Chamber)

Pensions

Before:                         Judge Mornington

Appellant:                A Taylor Surfacing

Respondent(s):      The Pensions Regulator

Case Management Order

(The Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009)

It is ordered:-

1.     The Appeal is struck out.

REASONS

2.            On 5 October 2024, the Appellant filed a GRC1 seeking to challenge a decision of the Respondent. This was incomplete because it was not clear whether the appellant has a right of appeal.

3.            On 28 November 2024, the Tribunal gave a Case Management Direction to for the Appellant to provide the “Pensions - right to appeal” form to the Tribunal within 28 days.

4.            On 24 January 2025, the Tribunal issued a further Case Management Direction to the Appellant for him to provide a copy of the form by no later than 7 February 2025. The Appellant was warned that failure to comply with this direction could lead to the Tribunal striking out the appeal.

5.            Under Rule 8(3), the Tribunal may strike out a case where:

(a) the Appellant has failed to comply with a direction which stated that failure by the appellant to comply with the direction could lead to the striking out of the proceedings or part of them; or

(b) the Appellant has failed to co-operate with the Tribunal to such an extent that the Tribunal cannot deal with the proceedings fairly and justly.

6.        Both circumstances are met in this case.

Signed: Judge Mornington

Date: 2 June 2025
