MR JUSTICE CHARLES: We are satisfied that the points in paragraph 5 of the Notice of Appeal raise points of law that are reasonably arguable. In addition it has been pointed out to us that the Tribunal did not have the benefit of the ECM decision when they reached their conclusion because it was not made until after that date.
For those reasons we are of the view that this appeal should proceed. So far as may be necessary any purported stay of the appeal proceedings should be lifted, but we understand that there probably was not one in the first place and that has been sorted out. In any event, and if it has not already occurred, we would recommend that there is a stay of the Employment Tribunal proceedings.
We will give this case Category A and a time estimate of a day.
