The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 1(1) and (2)(d) and 3 of, and paragraph 4(b) of schedule 2 of, the Public Service Pensions Act 2013( 1) and all other powers enabling them to do so.
In accordance with section 21(1) of that Act, the Scottish Ministers consulted the representatives of such persons as appeared to them likely to be affected by these Regulations.
In accordance with section 3(5) of that Act, these Regulations are made with the consent of the Treasury.
1. These Regulations may be cited as the Teachers’ Pension Scheme (Scotland) (Amendment) Regulations 2025 and come into force on 1 August 2025.
2. The Teachers’ Pension Scheme (Scotland) (No. 2) Regulations 2014( 2) are amended in accordance with regulations 3 and 4.
3. In Part 1 of schedule 1( 3), in paragraph 1(1), before the definition of “proprietor” insert—
““ immediately before ” means not more than twelve months before the commencement of the relevant employment; ”.
4. In Part 2 of schedule 1—
(a) in paragraph 6, for “teacher” substitute “lecturer”,
(b) after paragraph 15 insert—
“15A. Employment as a music instructor, educational psychologist, senior educational psychologist, depute principal educational psychologist, principal educational psychologist, education support officer, quality improvement officer or quality improvement manager in a public school or by an education authority.
15B. Employment as a researcher engaged in research in education at a college of further education, or institution providing higher education, as defined in the Further and Higher Education (Scotland) Act 1992( 4) , where the employee’s employment immediately before commencing that employment as a researcher was reckonable service under an enactment relating to pensions for teachers in Scotland, England, Wales or Northern Ireland.
15C. Employment for a temporary period not exceeding four years in a post connected to education, the control or supervision of teachers or lecturers, or services ancillary to education, where the employee’s employment immediately before commencing that employment was reckonable service under an enactment relating to pensions for teachers in Scotland.
15D. Employment by an education authority, college of further education or institution providing higher education, as defined in the Further and Higher Education (Scotland) Act 1992, in a post connected to the control or supervision of teachers or lecturers, where the employee’s employment immediately before commencing that employment was reckonable service under an enactment relating to pensions for teachers in Scotland, England, Wales or Northern Ireland. ”,
(c) in paragraph 16(1)—
(i) in head (b), omit “; or”,
(ii) in head (c), at the end insert—
“; or
(d) the teacher is employed by any other body constituted under an Act relating to education and which the Scottish Ministers agree to treat as an employing authority for the purposes of this part of the scheme ”.

These Regulations amend the Teachers’ Pension Scheme (Scotland) (No. 2) Regulations 2014, which set out the Scottish Teachers’ Pension Scheme 2015, to clarify and add to those categories of eligible employment for the purposes of that scheme which are specified in schedule 1 of those regulations. In particular, music instructors, educational psychologists, quality improvement managers, and certain other employments relating to educational research and the management of teachers, are added to the categories of eligible employment.
2013 c. 25. Section 3 was relevantly amended by section 94 of the Public Service Pensions and Judicial Offices Act 2022 (c. 7).
S.S.I. 2014/292, to which there are amendments not relevant to these Regulations.
Schedule 1 was amended by S.S.I. 2023/190.
