The Scottish Ministers make the following Order in exercise of the powers conferred by paragraphs 1(1), 2(1) and 3(3) of schedule 3 of the Road Traffic Act 1991( 1) and all other powers enabling them to do so.
In accordance with paragraphs 1(1)(d) and 2(1)(c) of that schedule the Scottish Ministers have received an application for this Order from Highland Council( 2).
In accordance with paragraphs 1(3) and 2(3) of that schedule the Scottish Ministers have consulted the chief constable of the Police Service of Scotland.
1. This Order may be cited as the Road Traffic (Permitted Parking Area and Special Parking Area) (Highland Council) Designation Amendment Order 2025 and comes into force on 24 June 2025.
2.—(1) Schedule 1 of the Road Traffic (Permitted Parking Area and Special Parking Area) (Highland Council) Designation Order 2016( 3) is amended in accordance with paragraphs (2) and (3).
(2) In paragraph 1, for “2 to 7”, substitute “2 to 27”.
(3) For paragraphs 2 to 7, substitute—
“2. That length of the A82 Dalnottar – Inverness Trunk Road in Inverness from a point on Glenurquhart Road 215 metres west of its junction with the circulatory carriageway of Torvean Roundabout in a generally northeasterly direction to its junction with the circulatory carriageway of Longman Roundabout on the M9/A9 Edinburgh – Stirling – Thurso Trunk Road, a distance of 4.75 kilometres or thereby.
3. That length of the A82 Dalnottar – Inverness Trunk Road in Fort William from a point on Achintore Road 2.99 kilometres or thereby southwest of its junction with the U1928 Ashburn Lane in a generally northeasterly direction to a point 357 metres or thereby northeast of the circulatory carriageway of the Road to the Isles Roundabout, a distance of 7.72 kilometres or thereby.

7. That length of the A82 Dalnottar – Inverness Trunk Road near Glen Coe from the centrepoint of the River Etive Bridge, generally in a westerly direction to its junction with the U1504 Old Glencoe Road, a distance of 12.71 kilometres or thereby.

9. That length of the A830 Fort William – Mallaig Trunk Road in Mallaig from a point 101 metres or thereby south of its junction with the West Bay Industrial Units Road generally in a northeasterly direction to and including the circulatory carriageway of the Roundabout at the Mallaig Ferry Port entrance, a distance of 270 metres or thereby.
15. That length of the A830 Fort William – Mallaig Trunk Road in Glenfinnan from a point 2.9 kilometres or thereby south-east of its junction with the U1191 Glenfinnan Pier Road (Slatach) generally in a north-west, west then north-west direction to a point 2.22 kilometres or thereby west of its junction with the U5397 Torr An Eas, Glenfinnan Road, a distance of 6.35 kilometres or thereby.
16. This Order amends the Road Traffic (Permitted Parking Area and Special Parking Area) (Highland Council) Designation Order 2016 (“ the 2016 Order”).
Article 3 of the 2016 Order designated the part of the Highland local government area specified in schedule 1 of the Order as a permitted parking area and as a special parking area in accordance with the provisions of schedule 3 of the Road Traffic Act 1991. While the Order is in force, certain specified parking offences are decriminalised in the Highland Council area.
Paragraph 1 of schedule 1 of the 2016 Order specified the whole of the Highland local government area, but excluded certain specified lengths of trunk road. The lengths of excluded trunk road are subject to the exceptions specified in remaining paragraphs of schedule 1 of the 2016 Order, with the effect of bringing those specified lengths within the designated area.
Article 2 of this Order substitutes the list of lengths of trunk road which are currently specified in paragraphs 2 to 7 of schedule 1 of the 2016 Order. The substituted list extends certain lengths of trunk road which were previously specified in the 2016 Order and adds a number of new lengths to that list. The effect of this is to extend the Highland local government area which is designated by article 3 of the 2016 Order as a permitted parking area and a special parking area.
1991 c. 40. Paragraphs 1(1) and 2(1) of schedule 3 were relevantly amended by the Local Government etc. (Scotland) Act 1994 (c. 39)(“ the 1994 Act”), schedule 13, paragraph 171. The functions of the Secretary of State under that schedule, so far as they are exercisable within devolved competence, were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c. 46).
