PLANT HEALTH

The Plant Health (Import Inspection Fees) (Scotland) Amendment Regulations 2007

  Laid before the Scottish Parliament 2nd March 2007 
  Coming into force 31st March 2007 

The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1] and section 56(1) and (2) of the Finance Act 1973[2], hereby make the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Plant Health (Import Inspection Fees) (Scotland) Amendment Regulations 2007 and shall come into force on 31st March 2007.

Amendment of the Plant Health (Import Inspection Fees) (Scotland) Regulations 2005
    
2. The Plant Health (Import Inspection Fees) (Scotland) Regulations 2005[3] are amended in accordance with regulations 3 and 4.

     3. Omit regulation 6 (notification of consignments).

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Plant Health (Import Inspection Fees) (Scotland) Regulations 2005 (S.S.I. 2005/216) ("the principal Regulations") and come into force on 31st March 2007. The principal Regulations implement Article 13d of Council Directive 2000/29/EC (O.J. No. L 169, 10.7.00, p.1) which requires Member States to charge fees to cover the costs occasioned by the documentary checks, identity checks and plant health checks of certain imports of plants, plant products and other items from third countries. They further implement reduced rates for certain plants and plant products agreed under the procedure provided for in Articles 13d(2) and 18(2) of the Directive.

Regulation 3 omits regulation 6 of the principal Regulations which dealt with notification of consignments as this matter is now dealt with by article 6 of the Plant Health (Scotland) Order 2005 (S.S.I. 2005/613) as amended by S.S.I. 2006/474.

Regulation 4 substitutes a new Schedule 2 to the principal Regulations, introducing new countries of origin and reduced rate fees.

Three new fruit types, Fortunella, Momordica and Passiflora are introduced with new fee scales for the countries of origin.

A new category of vegetable type Solanum melongena is introduced with fee scales for the country of origin.

No Regulatory Impact Assessment has been prepared for this instrument as it has no impact on the cost of business.
