      The Foot-and-Mouth Disease (Ascertainment of Value) (Scotland) Order 2001

        Made 22nd March 2001 
        Coming into force 2.30 p.m. on 22nd March 2001 

      The Scottish Ministers, in exercise of the powers conferred by sections 1 and 34(7) of the Animal Health Act 1981[1] and of all other powers enabling them in that behalf, hereby make the following Order:

      Citation, commencement and extent
           1.  - (1) This Order may be cited as the Foot and Mouth Disease (Ascertainment of Value) (Scotland) Order 2001 and comes into force at 2.30 p.m. on 22nd March 2001.

          (2) This Order extends to Scotland only.

      Ascertainment of value of an animal
          
      2.  - (1) For the purposes of the Animal Health Act 1981 the value of an animal caused to be slaughtered by the Scottish Ministers because of foot-and-mouth disease shall be ascertained in accordance with this article.

          (2) If the owner elects to have an animal valued by a valuer, the value, for the purpose of paragraph 3(2) of Schedule 3 to that Act, shall be the amount determined in writing by a valuer appointed jointly by the Scottish Ministers and the owner of the animal or, failing such appointment, by a valuer appointed by the President of the Institute of Auctioneers and Appraisers in Scotland.

          (3) If the owner does not elect to have the animal valued by a valuer in accordance with paragraph (2) above, the value shall be the amount set out for that animal in the Schedule to this Order.

          (4) The valuer shall be paid by the Scottish Ministers in respect of the expenses of that valuer incurred pursuant to this Order.

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This Order, which extends to Scotland only, establishes the system for ascertaining the value of animals slaughtered because of foot-and-mouth disease.

      A Regulatory Impact Assessment has not been prepared.
