      LOCAL GOVERNMENT

      The Ethical Standards in Public Life etc. (Scotland) Act 2000 (Commencement No. 1) Order 2001

        Made 15th March 2001 

      The Scottish Ministers, in exercise of the powers conferred by section 37(2) of the Ethical Standards in Public Life etc. (Scotland) Act 2000[1], hereby make the following Order:

      Citation
           1. This Order may be cited as the Ethical Standards in Public Life etc. (Scotland) Act 2000 (Commencement No. 1) Order 2001.

      Commencement of provisions
          
      2. The following provisions of the Ethical Standards in Public Life etc. (Scotland) Act 2000 shall come into force on 29th March 2001:-

        (a) sections 1 to 3, 8, 9, 28, 30, 31, 34 and 35;

        (b) schedules 1 to 3;

        (c) section 36(1), so far as relating to the provision in schedule 4 specified in paragraph (d) below;

        (d) in schedule 4, the repeal of section 28 of the Local Government Act 1988[
        2].

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This Order brings into force on 29th March 2001 certain provisions of the Ethical Standards in Public Life etc. (Scotland) Act 2000. The whole of that Act (other than section 37) falls to be brought into force by Commencement Order and this is the first such Order.

      The main provisions commenced are-

        (a) those provisions in the Act allowing the code of conduct for local authority councillors and the model code of conduct for members of certain public bodies to be laid before, and approved by resolution of, the Scottish Parliament;

        (b) the provisions about the Standards Commission for Scotland and about appointment of the Chief Investigating Officer and that Officer's staff; and

        (c) the provisions which repeal section 2A of the Local Government Act 1986 (c.10) (prohibition on local authorities' activities in connection with same-sex relationships) and impose new duties to children on local authorities.
