Coming into operation in accordance with regulation 1(2)

The Department of Health(1), makes the following Regulations in exercise of the powers conferred by sections 25C(1), (3)(c), (4)(d) and 25F(2) of the Public Health Act (Northern Ireland) 1967(2).

These Regulations are made in response to the serious and imminent threat to public health which is posed by the incidence and spread of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) in Northern Ireland.

The Department of Health considers that the restrictions and requirements imposed by these Regulations are proportionate to what they seek to achieve, which is a public health response to that threat.

In accordance with section 25Q of that Act the Department of Health is of the opinion that, by reason of urgency, it is necessary to make these Regulations without a draft having been laid before, and approved by a resolution of, the Assembly.

Citation, commencement and effect

1.-(1) These Regulations may be cited as the Health Protection (Coronavirus, Restrictions) (No. 2) (Amendment No. 11) Regulations (Northern Ireland) 2020.

(2) These Regulations come into operation at the time and on the date that they are made.

(3) Schedule 2 of the Health Protection (Coronavirus, Restrictions) (No. 2) Regulations (Northern Ireland) 2020(3) is amended in accordance with regulation 2.

Amendment of the Health Protection (Coronavirus, Restrictions) (No. 2) Regulations (Northern Ireland) 2020

2.-(1) In paragraph 3(5), for "and a self-catering holiday home" substitute ", privately owned holiday accommodation, a self-catering establishment and guest accommodation".

(2) In paragraph 5(2)(b), for "one individual and one coach or trainer and there is no contact between participants who are not members of the same household" substitute-

"(i) one individual and one coach or trainer and there is no contact between participants who are not members of the same household, or

(ii) one individual and their carer or carers.".

(3) In paragraph 7(2)(l), after "hotel" insert ", bunkhouse, hostel".

(4) In paragraph 7(3), after "an emergency" insert ", and in this paragraph "caravan" shall include any motor vehicle designed or adapted for human habitation".

(5) After paragraph 7(3) insert-

"(4) Sub-paragraph (2)(a) shall not prohibit or prevent the provision of a close contact service for the purpose of film or television production.

(5) In this paragraph "bunkhouse", "guest accommodation", "hostel" and "self-catering establishment" shall mean the premises of any establishment allocated by a certificate under Article 13 of the Tourism (Northern Ireland) Order 1992(4).".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, Restrictions) (No. 2) Regulations (Northern Ireland) 2020.

Regulation 2(1) clarifies the meaning of self-catering accommodation.

Regulation 2(2) provides for a person to take part in indoor exercise or sport with a carer or carers.

Regulation 2(3) requires the closure of hostels and similar establishments, with certain exemptions.

Regulation 2(4) provides that an exemption in relation to caravans also relates to motorhomes.

Regulation 2(5) provides that hairdressing, makeup and other close contact services may operate in film and television production, and defines certain terms.

No regulatory impact assessment has been prepared for these Regulations.
