TRANSPORT ACT (NORTHERN IRELAND) 1967 - SECT 43

Prosecutions.

43.(1) Proceedings for an offence under any of the provisions of Parts II and
III and this Part shall not be instituted except by the Ministry or by a
member of the Royal Ulster Constabulary.

(2) Summary proceedings for an offence under Part II, Part III or this Part
may be commenced at any time within the period of two years from the date of
the commission of the offence, or within the period of six months from the
date on which evidence sufficient to justify a prosecution for the offence
came to the knowledge of the Ministry, whichever period first expires.

(3) For the purpose of subsection (2) a certificate, purporting to be issued
by the Minister or a secretary or assistant secretary of the Ministry, as to
the date on which such evidence as aforesaid came to the knowledge of
the Ministry, shall be prima facie evidence thereof.
