PLANNING (NORTHERN IRELAND) ORDER 1972 - SECT 69



69. Where a claim for compensation is made to the Ministry under Part II, or
section 26 or 29, of the Act of 1965 in relation to a planning decision or
order, the Ministry may, if it appears to it that planning permission might
reasonably be expected to be granted (either unconditionally or subject to
conditions) for some development of the land to which the claim relates,
direct that in assessing the compensation payable in respect of the decision
or order it shall be assumed that permission for that development would
granted either unconditionally or subject to such conditions as may be
specified in the direction.
