MAGISTRATES' COURTS ACT (NORTHERN IRELAND) 1964 - SECT 94

Hearing of proceedings upon civil complaint.

94.(1) Where it has been unable for any reason to adjudicate upon the merits
of a complaint in a civil matter, the court may order that the complaint be
dismissed without prejudice to a further complaint alleging the same cause of
complaint.

(2) Where the court, having adjudicated upon the merits of a complaint in a
civil matter, dismisses the complaint the dismissal shall be expressed to be
on the merits.

Non-appearance of defendant.
