MAGISTRATES' COURTS ACT (NORTHERN IRELAND) 1964 - SECT 37D

1968 c.29

37D.(1) Where a person has been convicted in his absence by a
court of summary jurisdiction of an offence punishable with imprisonment and
the court

(a)cannot proceed in the absence of the accused by virtue of section 37C; or

(b)considers it undesirable by reason of the gravity of the offence to proceed
in his absence;

(2) Subsection (1) shall not apply where a court adjourns on the occasion of a
person's conviction in his absence under section 37A(2) except where that
person fails to appear at the time and place appointed for the adjourned
proceedings.]
