BUILDING SOCIETIES ACT (NORTHERN IRELAND) 1967 - SECT 131

Modifications of Act in relation to existing societies.

131.(1) For the purposes of section 29 of the Interpretation Act (Northern
Ireland) 1954, a resolution passed before the commencement of the Building
Societies Act (Northern Ireland) 1964, in accordance with any provisions of
the Building Societies Acts (Northern Ireland) 1874 to 1940, as then in force,
shall be treated as a resolution which could have been passed under the
corresponding provisions of this Act if it would have fallen to be so treated
if passed after the commencement of the said Act of 1964 as a
special resolution as defined by that Act.

(2) Any reference in any document (whether express or implied) to an enactment
repealed by this Act shall, except where the context otherwise requires, be
construed as, or as including, a reference to the corresponding provision of
this Act.

(3) Any power to make regulations under the Friendly Societies Act, 1896, in
so far as it would (apart from this Act) have been exercisable for the
purposes of section two or section four of that Act, shall continue to be
exercisable, in relation to the powers and functions referred to in those
sections respectively, as if this Act had not been passed.

(4) Where a period of time specified in an enactment repealed by this Act is
current at the commencement of this Act, this Act shall have effect as if the
corresponding provision thereof had been in force when that period began to
run.

(5) Any reference in this Act (whether express or implied) to a thing done or
falling to be done, or omitted to be done, or to an event which has occurred,
under or for the purposes of or by reference to a provision of this Act shall,
except where the context otherwise requires, be construed as including a
reference to the corresponding thing done or falling to be done, or omitted,
or to the corresponding event which occurred, as the case may be, under or for
the purposes of or by reference to the corresponding provision of the
enactments repealed by this Act.

(6) Where an offence, for the continuance of which a penalty was provided, has
been committed under an enactment repealed by this Act, proceedings may be
taken under this Act in respect of the continuance of the offence after the
commencement of this Act, in the same manner as if the offence had been
committed under the corresponding provision of this Act.
