S.I. No. 552/2016 - European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2016.

I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2010/63/EU of the European Parliament and the Council of 22 September 20101 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2016.

(2) These Regulations, the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2013 ( S.I. No. 434 of 2013 ), the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2014 ( S.I. No. 174 of 2014 ) and the Principal Regulations may be cited together as the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 to 2016.

2. In these Regulations “Principal Regulations” means the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 ( S.I. No. 543 of 2012 ).

3. Regulation 26 of the Principal Regulations is amended by substituting for paragraph (4) the following:

“(4) The IMB may extend the period referred to in paragraph (2) once, by an additional period not exceeding 15 working days, where—

(a) the extension is justified by the complexity or the multi-disciplinary nature of the project concerned, and

(b) the extension and its duration are duly motivated.”.

4. Regulation 27 of the Principal Regulations is amended by substituting for paragraph (2) the following:

“(2) A project authorisation granted under this Part shall be in writing and shall specify—

(a) the user who will undertake the project,

(b) the project manager(s),

(c) the establishment(s) in which the project will be undertaken, where applicable,

(d) whether, and in what manner, the user is authorised to rehome, or return to a suitable habitat or husbandry system, the animals used, and

(e) any specific conditions arising from the project evaluation, including whether and when the project shall be assessed retrospectively and limitations as to the severity of procedures.”.

5. Regulation 45 of the Principal Regulations is amended by inserting “on site” after “one or more persons”.

6. Regulation 50(1) of the Principal Regulations is amended by substituting “Breeders” for “Subject to paragraph (3), breeders”.

7. Regulation 75(7) of the Principal Regulations is amended by substituting “used or intended to be used under the authorisation” for “housed in his, her or its establishment”.

These Regulations amend the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 to give further effect to Directive 2010/63/EU of the European Parliament and the Council of 22 September 2010 on the protection of animals used for scientific purposes.

These Regulations may be cited as the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2016.
